What procedures must a foreigner follow to buy a home in Spain?
For a foreigner to purchase a home in Spain, several legal and administrative procedures must be completed. Below are the main steps:
Obtaining a Foreigner Identification Number (NIE): The NIE is a tax identification number required for any economic transaction in Spain, including the purchase of property. You must apply for it at the Immigration Office or the Spanish Consulate in your country of origin.
Open a bank account: It's advisable to open a bank account in Spain to facilitate transactions and payments related to your home purchase.
Search for a property: You can search for a home through real estate agencies, online real estate portals, or through real estate agents. It's important to consider factors such as location, property condition, price, and amenities available in the area.
Earnest Money Contract: Once you find a property, you typically sign an earnest money contract. This contract establishes the terms and conditions of the purchase, including the agreed-upon price and payment deadlines. Typically, a percentage (10%) of the total price is paid as a deposit.
Hire an expert: It's advisable to hire a real estate law expert to advise and represent you throughout the purchase process. They will verify the legality of the property, review the documents, and ensure everything is in order.

Obtain a mortgage loan (if necessary): If you need financing to purchase a home, you can apply for a mortgage loan from a bank or financial institution in Spain. You must provide the necessary documents and meet the requirements established by the lender.
Signing the deed of sale: Once all conditions are met and financing has been secured (if necessary), the deed of sale is signed before a notary. At this point, the agreed-upon price is paid, and the property is transferred to your name.
Paying taxes and fees: After signing the deed, you'll need to pay the taxes and fees associated with the home purchase, such as the Property Transfer Tax (ITP) or Value Added Tax (VAT), as well as notary and property registry fees.
